Communications Act 2003 Section 127

Section 127 of the Communications Act 2003 covers offensive and threatening messages sent over a "public" electronic communications network.  In recent years the Act, as well as similar clauses in the Malicious Communications Act, has been used in arrests and procecutions of messages sent using Twitter and Facebook, such as the Paul Chambers "Twitter Joke Trial" case.

ORG believes that, especially considering the change in the communications landscape in the decade since this law was passed, the scope and application of this power needs urgent re-examination.
