Very few sound recordings continue to make income so long after they were first produced, and those that do should have made enough for the artists to save some money for themselves in preparation for their work entering the public domain. And what about the welfare of society as a whole? Extending copyright restricts creativity by making it harder for new artists to use and build upon previous works - protecting the few does not promote social welfare in my view.

Why does the record industry have to be protected? New talent will emerge with or without it, the only difference is that these people will be making profit from their own talent rather than the record companies. Artists have more opportunity than ever to produce, market and distribute their own recordings thanks to developments in technology.
And forward-thinking record companies should be able to find ways of monetising records in this new economy, rather than relying on legislation to allow them to keep doing business the old way. Using these grounds as a justification for copyright extension is bordering on anti-competitive.

Extending copyright neither addresses nor solves the issue of falling sales in recorded music. Furthermore, I would like to second Mr Mytton's comment that evidence has shown that peer-to-peer filesharing isn't the cause of falling sales - to cite this as if it is a matter of fact and common knowledge with no evidence whatsoever simply doesn't cut the mustard.

As I understand, this proposal is for an extension to phonographic copyrights, not just performance copyrights - the fact that corporations as well as performers will benefit from this extension seems to have been conveniently overlooked.

As a re-issuer of public domain recordings I would like to see the an additional statement along the following lines inserted here in the proposed Directive would make the situation crystal clear:

The term extension in this Directive only applies to performances and sound recordings whose initial term of protection of 50 years has not expired at the date of adoption of the Directive. It does not retroactively extend to performances and sound recordings that have already fallen into the public domain by this date.

What happens if the recording having been maintained in the catalogue is deleted by the original copyright owner 2 years after the end of the original 50 year term? Does it now have protection for 95 years and become an orphan work?
